TERMS OF SERVICE

These Terms of Service ("Terms") govern your participation in, payment for, and attendance of courses provided by Safety First Training ("SFT"). By participating in, paying for, or attending our courses, you agree to be bound by these Terms. Please read them carefully.

For the purpose of improving accessibility, the language of the website will only be English.

1. Behavior

1.1 SFT reserves the right to deny service to individuals or groups who engage in obscene, disrespectful, disruptive, or otherwise inappropriate behavior during training sessions.

1.2 Individuals or groups displaying such behavior will be asked to leave the training session immediately without any refund being issued.

1.3 Individuals of groups who refuse to complete required portions of the course will be asked to leave and no refund or certification issued.

 2. Information Collection

2.1 SFT collects and maintains student information and purchaser information for internal use only, unless the information is requested by our training agreements with The American Red Cross or the Health and Safety Institute, or other payment or operation partners. 

2.2 Information collected may include names, phone numbers, emails, age or date of birth, and dates of prior and current certifications.

2.3 SFT ensures the privacy and security of collected information in accordance with applicable data protection laws and its Privacy Policy.

 3. Refund Policy

3.1 Individuals

3.1.1 Refunds are not issued, unless SFT Cancels the course. On a case by case basis, SFT May choose to allow the individual to attend a future course at no additional cost, or with a rescheduling fee, however it is not guaranteed.

3.2 Groups

3.2.1 Refunds are generally not issued to groups, unless SFT cancels a class.

3.2.2 Deposits made by groups are non-refundable, but in certain circumstances may be applied to a future course.

4. Chargebacks

4.1 In the event of chargebacks initiated by customers, SFT will review the circumstances to determine if they align with the refund policy stated above.

4.2 If the chargeback does not meet the refund policy, SFT reserves the right to take legal action to recover the original payment amount.

4.3 SFT also reserves the right to seek reimbursement for all fees associated with legal action, its time, and other associated expenditures.

 5. Intellectual Property

5.1 All course materials, including but not limited to presentations, handouts, manuals, and digital content, provided by SFT are protected by intellectual property laws.

5.2 Participants are prohibited from reproducing, distributing, or modifying any materials without prior written consent from SFT.

 6. Limitation of Liability

6.1 SFT's liability for any claims arising out of or relating to the services provided, including but not limited to negligence, shall be limited to the amount paid for the specific course.

6.2 SFT shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the participation in or use of its services.

 7. Governing Law

7.1 These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

 8. Modifications

8.1 SFT reserves the right to modify or update these Terms at any time.

 9. Severability

9.1 If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

 10. Entire Agreement

10.1 These Terms constitute the entire agreement between you and SFT and supersede any prior agreements or understandings, whether oral or written, relating to the subject matter herein.
